Terms of Use
Effective date: July 26, 2026
These Terms of Use ("Terms") are a binding agreement between you and ArtVal, Inc. ("ArtVal," "we," "us," or "our") and govern your access to and use of the ArtVal mobile application, the artval.ai website, and any related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE A BINDING ARBITRATION PROVISION AND A CLASS-ACTION WAIVER (SECTION 17) THAT AFFECT YOUR LEGAL RIGHTS, AND IMPORTANT DISCLAIMERS ABOUT THE NATURE OF ARTVAL APPRAISALS (SECTION 2).
1. The Service
ArtVal uses artificial intelligence to analyze photographs and descriptions of artworks and other objects and to generate informational reports, including identification suggestions, historical context, estimated market value ranges, comparable sales references, market listings, valuation history, and price forecasts (each, an "ArtVal Appraisal"). The Service also allows you to organize appraised works into a personal collection, record museum visits, maintain an artist portfolio, and generate exports such as PDF reports and certificates.
2. Appraisals Are for Entertainment and Informational Purposes Only
ArtVal Appraisals are AI-generated estimates provided for entertainment and general informational purposes only. They are not professional appraisals, and we make no guarantees of any kind regarding their accuracy, completeness, or reliability.
ArtVal Appraisals are generated by automated artificial-intelligence systems and may be incomplete, inaccurate, or entirely incorrect — including any identification, attribution, authenticity assessment, valuation, comparable sale, market listing, or forecast. Forecasts and price-history charts are modeled illustrations, not predictions. ArtVal Appraisals do not constitute, and must not be relied upon as:
- a professional, certified, or qualified appraisal of any kind (including any appraisal conforming to USPAP or comparable standards);
- financial, investment, tax, estate-planning, insurance, or legal advice;
- a valuation suitable for insurance coverage or claims, lending or collateral, charitable donation, equitable distribution, probate, tax reporting, customs, import/export, or any other official, regulatory, or legal purpose;
- an authentication, attribution, provenance verification, or certification of any artwork or object; or
- an offer to purchase, sell, or broker any artwork or object.
Any document generated by the Service titled or styled as a "certificate," including an "Appraisal Certificate," is a decorative summary of an AI-generated estimate. It is not a certification, authentication, or professional appraisal document and has no official standing.
Actual market values can differ substantially from any estimate shown in the Service. Before making any decision involving the purchase, sale, insurance, donation, or other disposition of an artwork or object, you must consult a qualified professional appraiser and conduct your own independent research. You bear sole responsibility for any decision you make in reliance on the Service.
3. Eligibility and Accounts
You must be at least 13 years of age (or the minimum age required in your jurisdiction, if higher) to use the Service, and at least 18 (or the age of majority in your jurisdiction) to make purchases. If you use the Service on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
An account is required to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it current. Notify us promptly of any unauthorized use of your account. We are not liable for losses caused by unauthorized use of your credentials.
4. Subscriptions, Credits, and Billing
The Service offers a limited number of free appraisals, paid subscription plans with a periodic appraisal allowance, and one-time appraisal credit packs. Current pricing, allowances, and plan features are shown in the app and are subject to change prospectively.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your app-store account settings; deleting the app does not cancel a subscription.
- Allowances. Unused subscription allowances do not roll over and expire at the end of each billing period. Allowances have no cash value and are not transferable.
- Credit packs. Purchased appraisal credits do not expire and are consumed only after your plan allowance is used, but they have no cash value, are non-transferable, and are not redeemable for money except where required by law.
- Purchases through app stores. Purchases made through the Apple App Store or other app-store platforms are processed by the platform, are subject to the platform's payment terms, and any refund requests must be directed to the platform. Except as required by law or by the platform's policies, all purchases are final and non-refundable.
- Failed appraisals. If an appraisal fails to complete due to an error on our side, the associated allowance use or credit is automatically restored; this is your sole remedy for a failed appraisal.
- Promotional codes. Gift or promotional codes may be subject to redemption limits and expiration dates, have no cash value, may not be resold, and may be revoked in cases of fraud or abuse.
- Changes. We may change prices, allowances, and plan features on a prospective basis. For subscriptions, price changes take effect at your next renewal, subject to any notice and consent requirements of the app store.
5. Your Content
You retain ownership of the photographs, notes, links, and other materials you submit to the Service ("User Content"). By submitting User Content, you grant ArtVal a non-exclusive, worldwide, royalty-free, sublicensable (to our service providers only) license to host, store, reproduce, process, adapt, and display that content solely as necessary to operate, provide, maintain, secure, and improve the Service and to comply with law.
You represent and warrant that you own or have the necessary rights to submit your User Content, that it does not infringe or violate the rights of any third party (including copyright, trademark, privacy, and publicity rights), and that it complies with applicable law. You must not submit content that is unlawful, infringing, deceptive, or that you do not have the right to share.
ArtVal Appraisals and other outputs are generated algorithmically and are not unique to you; similar or identical outputs may be generated for other users. Subject to these Terms, you may use the ArtVal Appraisals generated for you for your personal, non-commercial reference, and — if you are an artist pricing or listing your own work — alongside your own listings in accordance with Section 8.
If you provide feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
6. Acceptable Use
You agree not to:
- use the Service for any unlawful, fraudulent, or deceptive purpose, or in violation of these Terms;
- misrepresent an ArtVal Appraisal as a professional, certified, independent human, or qualified appraisal, or use it in any context where a professional appraisal is legally required (including insurance, lending, tax, customs, donation, or litigation);
- use the Service to facilitate the sale of counterfeit, forged, stolen, looted, or illegally exported works, or to lend false credibility to any listing or sale;
- reverse engineer, decompile, scrape, or extract data, models, or prompts from the Service, or use automated means to access the Service except as permitted by us in writing;
- use the Service or its outputs to develop or train a competing product or machine-learning model;
- circumvent usage limits, billing, or access controls, or share, resell, or commercially exploit access to the Service;
- interfere with or disrupt the integrity or performance of the Service; or
- attempt to gain unauthorized access to the Service or its related systems, or to another user's account or data.
We may investigate violations and may suspend or terminate accounts, remove content, and revoke credits obtained through fraud or abuse.
7. Public Portfolios and Shared Content
The Service may allow you to publish a public artist portfolio page or share reports, certificates, and images. Anything you choose to make public or share can be viewed, copied, and redistributed by others; share only what you are comfortable making public. You are solely responsible for the content of your public portfolio and shared materials, including their accuracy and legality. We may remove or disable public content that we reasonably believe violates these Terms or applicable law.
8. Sharing Appraisals in Listings
If you display an ArtVal Appraisal alongside a marketplace listing or in any other public context, you are responsible for presenting it accurately, including making clear that it is an AI-generated estimate provided for entertainment and informational purposes only and not a professional appraisal, authentication, or certification. You are solely responsible for compliance with the rules of any marketplace or platform where you display an ArtVal Appraisal and with all applicable consumer-protection, advertising, and truth-in-labeling laws.
9. Intellectual Property; Copyright Complaints
The Service, including its software, models, design, text, graphics, and the ArtVal name and marks, is owned by ArtVal or its licensors and is protected by intellectual-property laws. Except for the limited right to use the Service in accordance with these Terms, no rights are granted to you. You may not use the ArtVal name or marks without our prior written consent.
If you believe content available through the Service infringes your copyright, send a notice to info@artval.ai that includes: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. We will respond to valid notices, including by removing content and, where appropriate, terminating repeat infringers' accounts.
10. Third-Party Services and Content
The Service relies on and may reference third-party services and content, including app stores, authentication and payment providers, AI model providers, image-search providers, currency-rate and economic-data sources, and third-party marketplaces and listings. We do not control and are not responsible for third-party content or services. A reference to any third-party sale, listing, or price does not imply endorsement or verification, and third-party listings may be inaccurate, expired, or fraudulent. Your use of third-party services is subject to their own terms.
11. Apple App Store Terms
If you download the app from the Apple App Store: these Terms are between you and ArtVal, not Apple; Apple has no obligation to provide maintenance or support for the app; in the event of a failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any), and, to the maximum extent permitted by law, Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection claims; Apple is not responsible for third-party intellectual-property claims relating to the app. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country and that you are not on any U.S. Government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Disclaimer of Warranties
THE SERVICE AND ALL ARTVAL APPRAISALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT ANY ARTVAL APPRAISAL, IDENTIFICATION, ATTRIBUTION, LISTING, OR FORECAST WILL BE ACCURATE, COMPLETE, OR RELIABLE; OR THAT YOUR CONTENT WILL NOT BE LOST OR CORRUPTED. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN COPIES OF YOUR CONTENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTVAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY ARTVAL APPRAISAL — INCLUDING ANY PURCHASE, SALE, INSURANCE, DONATION, PRICING, OR OTHER DECISION MADE IN RELIANCE ON THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND (B) FIFTY U.S. DOLLARS (US $50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, and nothing in these Terms affects statutory consumer rights that cannot be waived.
14. Indemnification
You agree to indemnify, defend, and hold harmless ArtVal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, your public portfolio or other shared content, your display or use of any ArtVal Appraisal (including in any listing or sale), or your violation of these Terms or applicable law.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. You may stop using the Service and delete your account at any time in the app. Upon termination, your right to use the Service ends; unused allowances and credits are forfeited except where prohibited by law. Sections 2, 5 (license for content you shared publicly), and 9 through 19 survive termination.
16. Changes to the Service and These Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will provide notice through the Service or by other reasonable means, and the updated Terms will apply from their stated effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service.
17. Binding Arbitration and Class-Action Waiver
Please read this section carefully — it requires you to arbitrate disputes with ArtVal on an individual basis and limits the ways you can seek relief, unless you opt out as described below or applicable law provides otherwise.
You and ArtVal agree to first try to resolve any dispute informally: contact us at info@artval.ai with a description of the dispute, and the parties will attempt in good faith to resolve it within 60 days.
Except for disputes that qualify for small-claims court or seek injunctive relief for intellectual-property infringement, any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in English, by a single arbitrator, and may be conducted remotely. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
YOU AND ARTVAL EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Claims may be brought only in an individual capacity.
You may opt out of this arbitration agreement by emailing info@artval.ai within 30 days of first accepting these Terms, stating your name, the email associated with your account, and your intent to opt out of arbitration. If any part of this section is found unenforceable, the remainder remains in effect, except that if the class-action waiver is found unenforceable, this entire arbitration section is void. This section does not apply where prohibited by the law of your country of residence; consumers in the EEA or UK may bring claims in their local courts.
18. Governing Law
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws rules, except where the law of your country of residence provides otherwise and cannot be contractually waived. Subject to Section 17, any dispute not subject to arbitration will be resolved in the state or federal courts located in Delaware, unless applicable law grants you the right to bring the dispute in the courts of your place of residence.
19. General
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ArtVal regarding the Service. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. You agree to comply with applicable export-control and sanctions laws in connection with your use of the Service. Notices to you may be provided through the Service or to the email address on your account.
