Privacy Policy

This Privacy Policy explains how ArtVal, Inc. ("ArtVal," "we," "us," or "our") collects, uses, discloses, and protects information about you when you use the ArtVal mobile application, the artval.ai website, and any related services (collectively, the "Service"). If you do not agree with this Policy, do not use the Service.
1. Information We Collect
Information you provide:
- Account information: an account is required to use the Service. When you register, we collect your email address and, if you sign in with Google or Apple, the name and email address shared by that provider. Authentication is handled by our identity provider on our behalf.
- Photographs and images of artworks and objects you submit for analysis, including any additional views (signatures, marks, reverse sides) and optional wall-label photographs;
- Notes, descriptions, provenance details, acquisition and sale figures, tags, and other context you attach to a submission or add when editing a work;
- Web links you submit for link-based analysis;
- Portfolio information you choose to publish through a public portfolio page (see Section 5);
- Gift or promotional codes you redeem;
- Communications you send us (for example, support or contact emails).
Information collected automatically:
- Device and usage information, such as device type, operating system, app version, language setting, IP address, and general usage data (features used, appraisal counts, timestamps, and error logs);
- Derived data, such as cryptographic hashes of submitted images (used to recognize repeat submissions), valuation history snapshots, and appraisal usage records;
- Camera and photo-library access, only when you choose to capture or upload an image. We do not access your camera or photo library in the background.
Purchase information:
- Purchases are processed by the app-store platform (for example, Apple) and our subscription-management provider. We receive subscription status, product identifiers, and purchase records linked to your account so we can grant allowances and credits. We do not receive or store your full payment-card details.
2. How We Use Your Information
- To operate the Service, including generating ArtVal Appraisals from the images and context you submit;
- To store your appraised works in your personal collection, portfolio, and visit records within the app;
- To manage your account, subscription, allowances, and credits, and to prevent fraud and abuse of usage limits;
- To convert displayed values into your preferred currency and language;
- To maintain, secure, troubleshoot, and improve the Service, including diagnosing errors;
- To respond to your inquiries and provide support;
- To comply with legal obligations and enforce our Terms.

3. AI Processing and Image Search
To generate an ArtVal Appraisal, the images and context you submit are processed by artificial-intelligence models operated by third-party AI service providers acting on our behalf. To locate comparable listings, submitted images may also be processed by third-party visual-search services (for example, reverse-image search). These providers process your submissions to deliver the analysis to us and are restricted from using them for other purposes, in accordance with their applicable data terms. We do not use your images to train our own models.
AI outputs are automatically generated and may be inaccurate. Do not submit images or notes containing sensitive personal information you do not want processed by these providers.
4. How We Share Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only:
- With service providers who process data on our behalf — cloud hosting and database providers, our identity/authentication provider, AI analysis and visual-search providers, and our subscription-management provider — under agreements that limit their use of your information;
- When you choose to share content, such as exporting a report or certificate, sharing a share-card image, exporting a CSV, or publishing a public portfolio — what you share and with whom is under your control;
- To comply with law, legal process, or enforceable governmental requests, or to protect the rights, property, or safety of ArtVal, our users, or the public;
- In connection with a merger, acquisition, financing, or sale of assets, in which case we will continue to protect your information consistent with this Policy.
5. Public Portfolios and Shared Content
If you enable a public artist portfolio, the works you designate as your own — including images, titles, descriptions, and estimated values — are published on a public web page that anyone with the link can view, copy, or index. You can disable your public portfolio at any time in the app, which removes the page. Reports, certificates, and images you export or share leave our control once shared; review them before sharing.
6. Data Retention and Deletion
We retain the images, notes, and appraisal reports in your collection until you delete them in the app or delete your account. Deleting your account in the app permanently removes your artworks, images, collections, portfolio, share pages, and usage records from our production systems. We retain usage and diagnostic data for as long as reasonably necessary for the purposes described in this Policy, after which it is deleted or de-identified. We may retain certain records where required by law (for example, purchase records) and residual copies in backups for a limited period before they are overwritten.
7. Your Rights and Choices
- Deletion: You can delete individual artworks in the app, or delete your entire account and data from the Account screen. You may also contact us to request deletion.
- Access and correction: You may request a copy of the personal information we hold about you, or ask us to correct it. You can export your collection data as a CSV file directly in the app.
- Permissions: You can revoke camera and photo-library permissions at any time in your device settings; doing so limits the features that depend on them.
Depending on where you live (for example, the European Economic Area, the United Kingdom, or California), you may have additional rights, such as the rights to know, to object to or restrict certain processing, to data portability, and to non-discrimination for exercising your rights. California residents: we do not "sell" or "share" personal information as defined by the CCPA/CPRA, and we do not use or disclose sensitive personal information for purposes requiring a right to limit. To exercise any right, contact us at info@artval.ai; we will verify and respond to your request as required by applicable law. If you are in the EEA or UK, our legal bases for processing are performance of a contract (providing the Service), legitimate interests (securing and improving the Service, preventing fraud), and consent where required; you also have the right to lodge a complaint with your local supervisory authority.
8. Cookies and Local Storage
The Service uses only essential cookies and similar technologies (such as browser local storage) that are strictly necessary to operate the Service — for example, to keep you signed in, remember your language preference, record your cookie-consent choice, and protect the Service against fraud and abuse. We do not use advertising cookies, cross-site tracking cookies, or third-party analytics cookies on our website. Because these technologies are strictly necessary, they do not require opt-in consent in most jurisdictions; where notice or consent is required (for example, in the EEA or UK), we display a cookie notice. You can clear or block cookies and local storage in your browser settings, though doing so may prevent parts of the Service from working (such as staying signed in).
9. Security
We use administrative, technical, and organizational measures designed to protect your information, including encryption in transit and access controls that scope your data to your account. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. International Transfers
We are based in the United States, and your information may be processed and stored in the United States or other countries where we or our service providers operate. Where required, we use appropriate safeguards (such as standard contractual clauses) for international transfers.
11. Children's Privacy
The Service is not directed to children under 13 (or the minimum age required in your jurisdiction), and we do not knowingly collect personal information from them. If you believe a child has provided us personal information, contact us and we will delete it.
12. Changes to This Policy
We may update this Privacy Policy from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means. The "Effective date" above indicates when this Policy was last revised.
